China's Three Distinctive Assertions under the 'Nine-dash-line' Claims and the Annex VII Arbitral Tribunal's Interpretation of Article 121 Regarding an Island and Rocks under the 1982 UN Convention on the Law of the Sea
■ 概要
The author looks at China's three distinctive assertions under the 'Nine-dash-line' Claims and the Annex VII Arbitral Tribunal's interpretation of Article 121 regarding an island and rocks under the 1982 UN Convention on the Law of the Sea. He examines the historical background of the South China Sea to provide a context to understand China's nine-dash-line claim. He then goes on to analise the Arbitral Tribunal's characterisation and evaluation of the nine-dash-line claim. Given the Tribunal's decision against China, he looks at the imprecations of the ruling for China and ASEAN. He comments on the Tribunal's standards for determining maritime features such as rocks and islands under UNCLOS and what this means for Japanese claims.
